These terms are an agreement between you and whois.co.ke ("we", "us"). They apply when you search for a domain on this site, register, renew or transfer a domain with us, or use any of our other services. By using the site or placing an order, you agree to them. Please also read our Privacy Policy.
1. Our service
We are a KeNIC-accredited registrar. We register and manage .ke domain names on your behalf with KeNIC, the Kenya Network Information Centre, which operates the .ke registry. KeNIC's own registration policies, terms and dispute resolution policy apply to every .ke domain, alongside these terms. If they conflict with these terms, KeNIC's rules prevail.
2. Your account and eligibility
You must be at least 18 years old, or acting for an organisation with authority to bind it. You are responsible for keeping your account login safe and for everything done through your account. Tell us straight away if you think someone else has access to it.
3. Accurate registrant details
The person or organisation named as registrant is the holder of the domain. You must give complete, accurate and current registrant and contact details, and update them when they change. KeNIC may suspend or delete a domain registered with false, incomplete or out-of-date information, and so may we. We may ask you to confirm your details or provide identification.
4. Registering a domain
A domain is only registered once KeNIC has accepted it. Search results show the registry's status at the moment you search, but a name can be taken by someone else before your order completes. If we can't register a domain you have paid for, we will refund you in full.
Registering a domain does not give you any rights to a trademark or name. You are responsible for making sure your domain does not infringe anyone else's rights.
5. Restricted extensions
.ac.ke, .sc.ke, .go.ke, .ne.ke and .or.ke are for specific kinds of registrant and need supporting documents, such as proof of registration as a school, institution, organisation or network operator. We submit these orders once the documents are approved. If your application is refused, we refund what you paid for that domain.
6. Prices and payment
Prices are shown on our Pricing page in Kenya shillings per year, with VAT included. You pay in advance, by M-Pesa, card or another method we offer. We may change our prices, for example when KeNIC changes its fees, but a change never affects a period you have already paid for.
7. Renewals and expiry
Domains are registered for the period you pay for and must be renewed before they expire. We send renewal reminders to your account email before the expiry date, but renewing on time is your responsibility.
Under KeNIC's domain life cycle, an expired .ke domain is suspended about 14 days after expiry, so your website and email stop working. It can still be renewed during KeNIC's renewal grace period of up to 90 days. After that it is deleted and anyone can register it. Restoring a domain late in the grace period may cost more than a normal renewal.
8. Transfers
You can transfer a domain to us, or away from us, using its transfer (EPP) code. We give you the code for your domain on request and never hold a domain back to stop you leaving, unless it is the subject of a dispute, an unpaid invoice or a legal order. KeNIC charges a fee for transfers, which is included in our transfer price.
9. Refunds
Registration, renewal and transfer fees are paid to KeNIC once the order is processed, so they are not refundable after the domain has been registered, renewed or transferred. If an order cannot be completed, for example because the name was taken or an eligibility application was refused, we refund the full amount.
10. Acceptable use
You may not use a domain registered with us, or this site, for anything unlawful or harmful, including:
- fraud, phishing, scams or impersonating another person or organisation
- distributing malware or spam
- infringing trademarks, copyright or other rights
- content that is illegal under Kenyan law
Our domain search is for individual lookups. Automated, bulk or high-volume querying, and using lookup results to send unsolicited messages, are not allowed.
11. Domain name disputes
Disputes about who is entitled to a .ke domain are handled under KeNIC's alternative dispute resolution policy, which follows the principles of ICANN's Uniform Domain-Name Dispute-Resolution Policy (UDRP). By registering a .ke domain you agree to take part in that process if a complaint is filed. We follow the decisions made under it, and any order of a Kenyan court, including transferring or cancelling a domain.
12. Suspension and cancellation
We may suspend or cancel a domain or your account if you break these terms or KeNIC's policies, if a payment is reversed or not made, or if we are required to by KeNIC, a court or another authority. Where we can, we will tell you first and give you a chance to fix the problem.
13. Our responsibility to you
We provide the site and our services with reasonable care and skill. Search results come from KeNIC's registry and are provided as they are; we can't guarantee they are always complete or uninterrupted. We are not responsible for losses caused by things outside our reasonable control, such as registry or network outages, or for indirect losses such as lost profits. Nothing in these terms limits any rights you have under Kenyan consumer protection law that cannot be excluded.
14. Changes to these terms
We may update these terms, for example when KeNIC's policies or the law change. The date at the top shows the latest version. If a change significantly affects you, we will tell you by email before it takes effect.
15. Governing law
These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction over any dispute about them.
